In no order of importance, here are 5 reasons to estate plan….
- Don’t lose money and time to Probate. Probate will cost at least 3% of the GROSS estate and 8 months or more of time. The gross estate is the value of an estate without subtracting out debts or mortgages.
- Control who gets what, when, how, and how much with a Will, beneficiary plan, or Trust. If you don’t plan, then a Judge will make the decisions following state law. You may be surprised that your spouse doesn’t get your entire estate by default. In Arkansas, they are entitled to 1/3 of what you own in your name unless you have planned for them to get it.
- Control who makes financial, personal, and legal decisions for you in case you are incapacitated with a durable power of attorney. You decide not only who, but how much power they have instead of a Judge deciding for you. If a Judge ends up in control, then you and your family lose out.
- Control who makes your healthcare decisions when you can’t instead of a Judge with a durable power of attorney for healthcare. If you don’t choose now, then when something happens your family may end up in court letting a Judge make the decisions.
- Protect your family and heirs from themselves, creditors, and divorce. With proper planning, your family’s inheritance is protected. Without a plan, your children get their inheritance outright, exposing it to creditors, divorce, and financial predators.
You have 2 choices – plan or don’t plan.
