As people age decision making often becomes difficult if not impossible. It is at times like this that they will need help making decisions.

What is a Guardianship?

A Guardianship is a court order giving somebody else the authority to make decisions for another person. That person also has the responsibility to care for the “ward.” A guardianship can be for managing property, personal affairs or both.

In Arkansas, the guardian has limits. Before doing certain things, they must get permission from the Judge. Some of those things include removing life support, terminating parental rights, selling property, and taking away a driver’s license.

What are the Alternatives to a Guardianship?

The best alternative is to have a Durable Power of Attorney in place. The powers of attorney allow the “attorney in fact” to make the decisions about personal, financial, legal, and healthcare matters. You want the powers to be durable. Typically, powers of attorney end when a person becomes incompetent.

Advantages of Powers of Attorney over a Guardianship

People have the choice of who is given the power of attorney and can change it as needed.

  • People may end the power of attorney at any time.
  • Family doesn’t need to go to court.
  • No court supervision required.
  • Compared to a guardianship, the powers of attorney are inexpensive.
