What is a “Springing” Power of Attorney? (Video)

Some people think that a Power of Attorney should not be effective unless and until they become incompetent.

A Power of Attorney that is not effective immediately is called “springing”.

A “springing” Power of Attorney usually requires a finding of incompetency by at least one doctor and sometimes two. This can cause delay and there may be situations where a doctor will not sign off that you are incompetent.

Making your POA effective immediately removes the need for a doctor to declare you incompetent.

Furthermore, if you make your Power of Attorney effective immediately, while you are competent, you have the opportunity to observe your Agent and if you find that he is abusing his authority, you can remove him immediately.
