You might have heard that you automatically have a power of attorney over your spouse.

That just isn’t true. The law in this case considers the individual to be separate and apart, not part of the marriage. You don’t automatically get permission to make your spouse’s decisions.

When Mary went to apply for Medicaid for her husband Mark, she found out that she couldn’t make the application on his behalf without a power of attorney. In addition to the stress of applying for Medicaid, she also had to get a guardianship which delayed the application for more than a month. So, on top of the $3,000 for the guardianship, she also had to pay $6,000 for a month of nursing home care.
